1. Agreement to Terms

Welcome to Starlinker NG ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our platform, website, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Starlinker NG under the laws of the Federal Republic of Nigeria.

2. Eligibility

• Maintain the security of your account credentials

3. Services Offered

3.1 WiFi Bypass Service

• Provides temporary internet access through secure connections
• Subscription-based service with various duration options
• Subject to network availability and technical limitations
• No guarantee of uninterrupted service

3.2 Professional Services

• Booking and scheduling of professional services
• Service delivery subject to provider availability
• Cancellation and rescheduling policies apply

3.3 E-Commerce Platform

• Online marketplace for goods and products
• Product availability subject to stock
• Delivery within specified service areas
• Return and refund policies apply

4. Account Registration and Security

4.1 Account Creation

You must create an account to access certain features. You agree to:

• Provide accurate and truthful information
• Maintain one account per person
• Keep your login credentials confidential
• Notify us immediately of unauthorized access
• Update your information to keep it current

4.2 Account Responsibilities

You are responsible for all activities under your account. We are not liable for losses arising from unauthorized use of your account unless caused by our gross negligence.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for any reason at our discretion with notice.

5. Payment Terms

5.1 Pricing

• All prices are in Nigerian Naira (₦) unless otherwise stated
• Prices include applicable VAT where required
• We reserve the right to change prices with notice
• Price changes do not affect existing subscriptions until renewal

5.2 Payment Methods

We accept:

• Debit/Credit cards via Paystack
• Bank transfers
• Wallet balance

5.3 Payment Processing

• Payments are processed securely through Paystack
• We do not store complete card details
• Payment confirmation may take up to 24 hours for bank transfers
• Failed payments may result in service suspension

5.4 Billing

• Invoices are generated for all purchases
• Digital receipts sent via email
• Recurring subscriptions billed automatically
• Billing disputes must be raised within 30 days

6. Refund and Cancellation Policy

6.1 WiFi Bypass Subscriptions

• No refunds after password delivery unless service is non-functional
• Technical issues must be reported within 24 hours
• Refunds processed within 7-14 business days
• Cancellations do not result in partial refunds

6.2 Professional Services

• Free cancellation up to 24 hours before appointment
• Cancellations within 24 hours: 50% charge
• No-shows: Full charge
• Provider cancellations: Full refund

6.3 Shop Products

• Returns accepted within 7 days of delivery
• Products must be unused and in original packaging
• Buyer pays return shipping unless product is defective
• Refund processed after inspection (5-7 business days)
• Digital products: No refunds after delivery

6.4 Exceptions

Refunds may be denied for abuse of refund policy or fraud. All refund decisions comply with the Nigerian Consumer Protection Act.

7. Delivery Terms

• Delivery Areas: Limited to specified service zones
• Delivery Times: Standard (3-5 days), Express (1-2 days)
• Delivery Fees: Based on location and selected method
• Failed Delivery: Recipient must be available; re-delivery fees may apply
• Inspection: Check products upon delivery; report damage immediately
• Force Majeure: Delays due to circumstances beyond our control

8. User Conduct

You agree NOT to:

• Violate any Nigerian laws or regulations
• Infringe on intellectual property rights
• Share account credentials with others
• Use our Services for fraudulent purposes
• Attempt to hack, disrupt, or reverse-engineer our platform
• Resell Services without authorization
• Use automated tools (bots, scrapers) without permission
• Harass, abuse, or threaten other users or staff
• Post false reviews or manipulate ratings
• Circumvent payment systems or security measures

Violation of these terms may result in account suspension, termination, and legal action.

9. Intellectual Property Rights

9.1 Our Property

All content, features, and functionality on our platform, including but not limited to text, graphics, logos, icons, images, audio, video, software, and their compilation, are the exclusive property of Starlinker NG and protected by Nigerian and international copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms.

9.3 User Content

By submitting content (reviews, comments, photos), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for operating and improving our Services.

10. Disclaimers and Limitations

10.1 Service Availability

Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation. Service availability depends on third-party infrastructure.

10.2 Third-Party Services

We use third-party services (payment processors, logistics). We are not responsible for their actions or failures beyond our reasonable control.

10.3 Limitation of Liability

To the maximum extent permitted by Nigerian law, Starlinker NG shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount paid by you in the past 6 months
• Issues arising from your violation of these Terms
• Force majeure events (natural disasters, government actions, etc.)

10.4 Consumer Protection

Nothing in these Terms limits your statutory rights under the Nigerian Consumer Protection Act where such limitations are prohibited by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Starlinker NG, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of Nigerian law

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at starlinker.com@gmail.com to seek informal resolution. We commit to good faith efforts to resolve disputes amicably.

12.3 Arbitration

If informal resolution fails, disputes may be resolved through arbitration in Lagos, Nigeria, under the Arbitration and Conciliation Act. The arbitrator's decision is final and binding.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting with the updated "Last updated" date. Material changes will be communicated via:

• Email notification to registered users
• Prominent notice on our platform
• In-app notification

Continued use after changes constitutes acceptance. If you disagree with changes, discontinue use of our Services.

14. Termination

14.1 By You

You may terminate your account at any time by contacting customer support. Termination does not entitle you to refunds for unused services.

14.2 By Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• We suspect fraudulent activity
• Required by law or government request
• We discontinue Services (with reasonable notice)

14.3 Effect of Termination

Upon termination:

• Your right to access Services ceases immediately
• You remain liable for outstanding payments
• Provisions regarding intellectual property, disclaimers, and limitations survive
• We may retain data as required by law

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Starlinker NG.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

15.3 Waiver

Failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, strikes, government actions, etc.).
